Packaging and Producer Responsibility
![]() Packaging is defined as any product which is used or intended to be used to contain or protect goods OR to aid their handling, delivery or presentation. Products are considered to be 'packaging' at all stages of the process of manufacture or distribution, starting as 'raw materials' and ending when finally delivered to the end user or consumer. The Producer Responsibility Obligations (Packaging Waste) Regulations 1997. The regulations are intended to raise environmental awareness and to increase the quantities of RECOVERED and RECYCLED packaging waste. British businesses are now legally obliged to meet specified recycling targets based upon the annual weight of packaging which they handle. As a waste holder or producer, you're responsible for your own disposal obligation. The Environment Agency (EA) is the government agency charged with upholding the law and ensuring that businesses based in England and Wales comply with the regulations. The Scottish Environment Protection Agency (SEPA) is the body responsible for companies operating north of the border. The legislation for 2006 states that any business with an annual turnover in excess of £2 million that produces more than 50 tons of packaging waste per annum has a legal obligation under the regulations to ensure the correct percentage of that waste is recycled.
